West Chester Borough Council has scheduled a public hearing titled “Prohibition of Kratom Products” for 6:30 p.m. Wednesday, Nov. 18, at the Municipal Building, 401 E. Gay St.

The time and location are listed on the borough’s official calendar. The meeting’s document page lists a notice and an additional file for the hearing.

A scheduled hearing is not evidence that a ban has already been adopted. The calendar title alone does not establish the proposal’s exact restrictions, penalties or exemptions. Those details should be checked against the proposed ordinance and any amendments considered by council.

Kratom and concentrated products

Kratom is a Southeast Asian tropical tree, Mitragyna speciosa. Its leaves contain several alkaloids, including mitragynine and naturally occurring 7-hydroxymitragynine, or 7-OH.

The Food and Drug Administration distinguishes naturally occurring trace amounts of 7-OH from concentrated products. It says there are no FDA-approved kratom drugs and warns of serious risks including liver toxicity, seizures and substance use disorder. FDA also notes that the role of kratom in reported deaths can be difficult to determine when other drugs are involved.

In its current federal policy update, FDA describes Oct. 9 notices of intent concerning 7-OH and related compounds. The approach is intended to distinguish intentionally concentrated or enhanced products from botanical kratom. A federal notice of intent is a separate process from West Chester’s proposed local ordinance.
